Does a recorded lien mean my property is being foreclosed on?
Not necessarily.
A lien may be recorded against a property as part of the lien-enforcement process without foreclosure proceedings having begun.
If your account remains unresolved after a lien has been recorded, however, the Association may consider further lien-enforcement action.
If you have received correspondence from Severaid & Glahn, read the specific notice carefully. It will help you understand the current status of your account and any action you may need to take.
What is a Notice of Default (NOD)?
A Notice of Default, often referred to as an NOD, is a formal step that may occur after a lien has been recorded and the account remains unresolved.
Before proceeding to this stage, additional action and authorization may be required from the Association.
Receiving correspondence concerning a possible NOD should be taken seriously, but the particular notice you received is important. A letter discussing a possible NOD is not necessarily the same as an NOD having been recorded.
What should I do if I receive a Pre-NOD or foreclosure-related notice?
Do not ignore the notice.
Review the notice and the ledger provided with it. Depending on the status of your account, you may still have options for resolving the matter before additional action occurs.
- Paying the balance in full
- Submitting a written payment plan request
- Requesting Meet & Confer with your Association to discuss your account and explore potential resolution options
- Contacting our office if you believe the balance is incorrect
- Providing documentation if you believe a payment is missing
Please have your Severaid & Glahn file number or property address available when contacting our office.
Can I request a payment plan at this stage?
You may submit a written payment plan request for consideration.
A payment plan request is not automatically approved. The Association will consider the proposed terms and determine whether the request will be approved, denied, or whether different terms will be offered.
See our Payment Plans page for information about preparing and submitting your request.
Can I request a waiver?
Yes. You may submit a written request asking the Association to consider waiving eligible charges.
Lien costs are not eligible for waiver.
A waiver request may be submitted separately or together with a payment plan request. If you want to request both, submitting them together allows the Association to consider both requests at the same time.
See Waiver Requests for additional information.
What if I believe the balance is wrong?
If you believe there is an error on your account, please contact our office and explain the item you are questioning.
If you made a payment to the Association or management company that does not appear on the ledger, please provide proof of payment.
For payment by check, we will need a copy of both the front and back of the cleared check so the payment can be researched.
If you have received a foreclosure-related notice, do not delay contacting our office simply because you believe the balance is incorrect.
What happens if the account is not resolved?
If the account remains unresolved, the Association may elect to proceed with further lien-enforcement action.
The particular steps that may apply depend upon the status of the account and the action authorized by the Association.
Additional fees, costs, and interest may accrue as the matter proceeds.
Because the circumstances of individual accounts can differ, please refer to the correspondence sent to you by our office for information regarding your particular matter.
Has a foreclosure sale already been scheduled?
If you have received a notice concerning foreclosure, do not assume from the word “foreclosure” alone that a sale has already been scheduled.
Different notices may be sent at different stages of the process.
Please review the specific correspondence you received. If you are unsure of the status of your account or what the notice means, contact our office.
Can I sell or refinance the property while this is happening?
If you are selling or refinancing the property, your escrow or title company may request a payoff demand from our office to determine the amount necessary to resolve the lien-enforcement account through the anticipated closing date.
Please see Payoff / Demand Requests for instructions.
